Peoria Marriage License Rules

Illinois law controls how marriage licenses work in Peoria. Under 750 ILCS 5/207, a marriage license becomes effective one day after it is issued. That means you cannot have your ceremony on the same day you pick up the license at the Peoria County Clerk's office. This 24-hour waiting period applies to all couples in Illinois. Once the waiting period passes, the license stays valid for 60 days. If you do not use it within that window, it expires and you would need to pay the $75 fee again for a new one in Peoria.

Both parties must be at least 18 to get a license in Peoria. Anyone between 16 and 17 needs judicial approval under 750 ILCS 5/208. If either person was married before, you must tell the clerk when and where that marriage ended. There is an extra step if a divorce was finalized less than six months ago. In that case, you must bring a certified copy of the divorce decree to the Peoria County office before the clerk can issue a new marriage license.

Note: A Peoria County marriage license is valid for ceremonies held anywhere in Illinois, not just in Peoria.

Getting Married in Peoria

Peoria County offers civil ceremonies performed by a judge. You can do the ceremony in person at the courthouse or through Zoom. The fee is $10 for either option. Call (309) 672-6984 to set up a time. This is separate from the marriage license fee. After the ceremony, the signed license goes back to the Peoria County Clerk, where it becomes a permanent marriage record.

You can also have any ordained minister, judge, or other person allowed under 750 ILCS 5/209 perform your marriage ceremony in Peoria. The officiant must sign the license and return it to the Peoria County Clerk within 10 days of the ceremony. Once the clerk gets the signed license back, your marriage record is complete and on file. If the license is not returned on time, there could be delays or problems with your Peoria marriage record. Make sure whoever performs the ceremony knows they need to file the paperwork.

The Peoria County Clerk issues certified copies with the official county seal. Plain copies without the seal may be available for personal use, but they are not accepted for legal matters. Call (309) 672-6059 to ask about current fees and what type of copy fits your needs for Peoria marriage records.

The state also offers a basic option. The Illinois Department of Public Health can verify facts about a marriage that took place in Peoria. This is not a certified copy. It only confirms names, dates, and the county. The state has records from 1962 on, and the fee is $5 per search through the IDPH Division of Vital Records. Processing takes about 12 weeks, so for most situations in Peoria, going to the county clerk is faster.
